By creating an account, using OnCourt, or making a booking, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the service.
2. Eligibility
You must be at least 18 years old or have parental consent. You must have the legal capacity to enter into a binding agreement.
3. Account and Security
- You are responsible for all activity under your account.
- Keep your credentials secure and notify us immediately of any unauthorized use.
- We may suspend or terminate accounts that violate these Terms.
4. Service Description
OnCourt is a platform that:
- Displays venue profiles, court availability, prices, and policies.
- Facilitates reservations and payments between players and venues.
- Does not own or operate the venues.
Venue Control
Venues decide scheduling, pricing, rules, and acceptance or rejection of bookings.
5. Bookings
- Instant booking vs request: Some courts confirm instantly. Others require venue approval.
- Booking window and cut-off: Bookings may be limited by advance windows and same-day cut-offs.
- Duration and court type: As shown at checkout; venues may reassign you to a comparable court if needed.
- No-shows and late arrivals: Venues may release courts after a grace period and may apply fees.
6. Pricing, Fees, and Payments
- Currency: Prices are shown in Thai Baht (THB) unless stated otherwise.
- Taxes and fees: Prices may include or exclude taxes, service fees, or venue surcharges as displayed at checkout.
- Payment processing: Payments are processed by authorized payment providers. You authorize charges to your selected method.
- Holds and pre-authorizations: Some bookings require a hold or deposit.
- Chargebacks: You agree to contact us first to resolve disputes. Unfounded chargebacks may lead to suspension.
7. Cancellations, Changes, and Refunds
- Player cancellations: Refundability depends on the venue's policy and any cut-off times shown at booking.
- Venue cancellations: If a venue cancels, you will receive a refund or credit per the venue or OnCourt policy.
- Weather and force majeure: Venues may allow rescheduling or credit at their discretion.
- How refunds work: Approved refunds are processed to the original payment method; timing depends on your bank.
8. Venue Rules and Conduct
- Follow venue rules, staff instructions, and safety guidelines.
- Wear proper attire and non-marking shoes.
- Do not damage property or disturb others. Venues may charge for damages or refuse service.
9. User Content (Reviews, Photos, Profile)
- You are responsible for any content you submit.
- Do not post illegal, abusive, or misleading content.
- By submitting content, you grant OnCourt a non-exclusive, worldwide license to use, display, and distribute it for service purposes.
- We may moderate or remove content that violates these Terms.
10. Prohibited Uses
Do not:
- Interfere with the service, scrape data, or reverse engineer.
- Misrepresent identity, create fraudulent bookings, or attempt to avoid venue policies or deposits.
- Use the platform for any unlawful purpose.
11. Privacy
Your use is subject to our Privacy Policy, which explains what data we collect and how we use it.
12. Intellectual Property
- OnCourt and its logos, trademarks, and software are owned by us or our licensors.
- You may not copy, modify, or create derivative works except as permitted by law.
13. Third-Party Services and Links
OnCourt may link to third-party sites or services. We are not responsible for their content, policies, or practices.
14. Disclaimers
- OnCourt provides the platform "as is."
- We do not guarantee venue availability, quality, or suitability.
- To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of Liability
To the maximum extent permitted by law:
- OnCourt is not liable for indirect, incidental, or consequential damages.
- Our total liability for any claim related to the service will not exceed the greater of THB 3,000 or the total fees you paid to OnCourt for the booking giving rise to the claim.
16. Indemnification
You agree to indemnify and hold harmless OnCourt and its affiliates from claims arising out of your misuse of the service, breach of these Terms, or violation of law or third-party rights.
17. Suspension and Termination
We may suspend or terminate your access for violations, suspected fraud, or security risks. You may stop using the service at any time. Certain clauses survive termination.
18. Changes to the Service and Terms
We may modify the service or these Terms. If we make material changes, we will notify you by app notice or email. Continued use after changes means you accept the updated Terms.
19. Governing Law and Dispute Resolution
- Governing law: Laws of the Kingdom of Thailand.
- Jurisdiction: Courts of Bangkok (Thailand) have exclusive jurisdiction, unless local consumer laws require otherwise.
- Informal resolution first: Contact support to try to resolve disputes before taking formal action.
